Parlamentares divulgam minuta do projeto que regulamenta apostas no Brasil
Na última quarta-feira, 24 de novembro, o Grupo de Trabalho (GT) que revisou o PL 442/9, que visa a instituição da atividade de jogos no Brasil, disponibilizou a minuta inicial do projeto. Apresentada pelo relator do GT, Deputado Felipe Carreras, o documento é uma espécie de rascunho daquilo que deve ser apresentado para aprovação no Congresso Nacional.
O texto apresentado pelo Deputado Felipe Carreras não é a versão final do projeto, mas sim apenas uma base para promover algumas discussões com os outros parlamentares. Como está sujeita a alteração, a minuta será discutida e todas as alterações que forem sugeridas e acatadas estarão presentes no relatório final do projeto, a ser apresentado ao Presidente da Câmara dos Deputados, Arthur Lira.
Segundo o portal Games Magazine Brasil, o documento elenca, no art. 8º, as modalidades de jogos e apostas que devem ser autorizadas no país, sendo elas: cassino, bingo, jogo do bicho, apostas de quota fixa, apostas turfísticas e jogos de habilidade. Contudo, a minuta do relatório não define os modelos de cassinos a serem implantados no Brasil.
Sistema Nacional de Jogos e Apostas
Além de informações a cerca dos processos de regularização, o documento também sustenta a ideia da criação de um órgão regulador federal, denominado Sistema Nacional de Jogos e Apostas, para controle das entidades operadoras de jogos e apostas, entidades turfísticas e agentes de jogos e apostas, além de empresas de auditoria e entidades de autorregulação do mercado.
Outras informações importantes
Fora a criação do Sistema Nacional de Jogos e Apostas, o documento também indica que as empresas que desejam atuar no país devem ter sede e administração no país e estarão sujeitas às normas a serem definidas por órgão regulador e supervisor federal, que estabelecerão os critérios para a concessão da licença de operação.
Em relação às regras para cada modalidade de jogo, elas ainda não foram estabelecidas e estão, de acordo com o documento, em elaboração ou revisão, assim como não estão definidas taxas de licenciamento, impostos e divisão dos recursos entre União, Estados e Distrito Federal.

Regularização caminha
Finalmente estamos conseguindo ver o projeto de regulamentação das apostas esportivas no Brasil caminhar para além das ideias e dos discursos. O andamento do processo é uma realidade, e a divulgação do texto base da lei é o primeiro passo para promover as últimas discussões e ajustes antes de finalizar o relatório do projeto para, enfim, apresentá-lo para votação no Congresso Nacional.
Em relação ao teor do documento, me preocupa um pouco a obrigatoriedade de ter sede e administração por aqui para as empresas de apostas interessadas em regularizar a situação no país. Sou absolutamente leigo e não me arrisco a dizer se isso é ou não um problema, mas talvez tenhamos um empecilho importante para as empresas nesse ponto da lei. Contudo, vale salientar que a minuta é apenas um texto inicial e que pode muito bem ser alterado. A versão final do projeto de lei deve ser bem diferente do que foi divulgado nesta semana.
